GluApp Terms of Service

1. Acceptance of Terms

By creating a GluApp account or using the app, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. The account registrant must be 13 or older. If you add a care profile for a child, you represent that you are a parent or legal guardian (or have authority) and that you consent to processing that child’s information as described in the Privacy Policy.

2. Description of Service

GluApp is a diabetes education and monitoring application. It can display glucose from Dexcom Share, LibreLinkUp, or Nightscout, send optional supplemental alerts, support caregivers/followers, education, games, reports, and an optional GluBear Bluetooth companion. It is not a replacement for your CGM, clinic devices, or emergency care.

3. Medical disclaimer and device warnings

IMPORTANT: GluApp is NOT an FDA-cleared or FDA-approved medical device. It is not a substitute for professional medical advice, diagnosis, or treatment.

• For educational and secondary monitoring purposes only.
• Do not make medication or treatment decisions based solely on this app.
• Always seek advice from qualified healthcare providers.
• Keep your CGM primary alarms and emergency protocols on at all times.
• App data may contain errors — verify with your clinician and approved medical devices.
• GluBear is educational/comfort only and requires adult supervision.
• GluBear and GluApp are not intended to replace primary CGM alarms or medical advice. They are secondary displays and educational/comfort tools. Always keep your CGM system’s built-in alerts and your care team’s emergency plan.

4. User responsibilities

You are responsible for:

• Keeping your password, Parent PIN, and account confidential.
• The accuracy of information you enter and CGM connections you maintain.
• Inviting only people who should see shared glucose/care data.
• Keeping emergency contacts and contact information up to date.
• Complying with Dexcom, Abbott, Nightscout, Apple, and Google terms for those services.

5. Subscriptions and in-app purchases

Paid GluApp access is sold as an auto-renewable subscription through the Apple App Store or Google Play (product gluapp_premium_monthly). Typical offer: 30-day free trial, then $8.99 USD per month, unless the store listing or a prepaid hardware bundle says otherwise. Price in your local store may vary by currency and tax.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase (or when a trial converts).
• The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
• Manage or cancel in Apple Settings → Subscriptions or Google Play → Payments & subscriptions. Deleting the app does not cancel the store subscription.
• Restore Purchases is available in the app if you reinstall or change devices.
• Website hardware bundles (if any) are separate from in-app billing and may be processed on myglubear.com.

6. App permissions

By using the app you consent to the permissions described in the Privacy Policy: Bluetooth for GluBear only (not CGM, not GPS), photo library for paintings and optional bug screenshots (no camera), microphone for local GluBear voice messages, optional notifications, optional Face ID/Touch ID, and internet for sync. We do not track your physical location.

7. Privacy

We process data as described in the Privacy Policy (https://myglubear.com/app/privacy), including health data with your explicit consent. You can export or delete data from Settings as described there.

8. Acceptable use

You may not misuse the service, attempt unauthorized access, interfere with other users, scrape or reverse engineer the app except as allowed by law, or use GluApp to provide emergency medical treatment.

9. Intellectual property

GluApp, GluBear, and related names, graphics, education content, and software are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, revocable license to use the app for your personal, non-commercial diabetes-care and education use.

10. Service availability

We strive for reliable service but do not guarantee uninterrupted availability. Networks, CGM vendor APIs, and your device can fail. Keep your CGM’s primary alarms and a backup emergency plan. We are not responsible for losses from outages, delayed alerts, or inaccurate third-party CGM data.

11. Limitation of liability

To the maximum extent permitted by law, GluApp and GluBear / MyGluBear are not liable for indirect, incidental, special, consequential, or punitive damages, or for treatment decisions, missed hypoglycemia or hyperglycemia, or errors in glucose data or alerts. Our total liability for claims relating to the service is limited to the amount you paid us for the app in the 12 months before the claim, or fifty U.S. dollars, whichever is greater. Some jurisdictions do not allow certain limitations; those limits apply only to the extent permitted.

12. Termination

You may stop using GluApp and delete your account in Settings → Profile & Account. We may suspend or terminate access for conduct that violates these Terms or harms users or the service. Store subscriptions must be cancelled with Apple or Google separately.

13. Changes

We may update these Terms. We will post the new version in the app and at https://myglubear.com/app/terms and update the Last Updated date. Continued use after the update means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your place of residence says otherwise. If a provision is unenforceable, the rest remains in effect.
